5/27/2025 New Construction – What’s Your Role & Risk?

New Construction deals may appear to be easy, but there’s more to it than you might think!
  • What should you expect at the initial showing and meeting?
  • How do you know what’s standard vs. an upgrade? For example: flooring, finishes, appliances, landscaping, etc.
  • Can/how do you negotiate with a builder?
  • Is it best to have the builder install the “upgrades” – such as additional outlets, ceiling fans, etc. – or to have a contractor perform the work after closing?
  • What is your liability with the builder contract and forms?
  • Do you have a responsibility to interpret all of the builder documents?
  • How do builder warranties work and differ?
  • What are the “secrets” you should be aware of?
  • Are you obligated to attend all of the meetings throughout the building process, such as the design center, the various walk-throughs, the final “tape walk”?
  • How do you ensure that you’ll get paid?
  • And perhaps most importantly – how do you best meet your obligations to your Buyer?
