The Contract to Buy and Sell has seen a significant number of changes over the years that affect the lender and loan process! As Brokers, we fill in the blanks and complete the Contract, but sometimes fail to consider the other players on the playground. Think you can just whip up an Amend/Extend? That’s great…..so long as both parties are willing to sign it.
Many sections of the Contract directly impact the lender, including the Buyer’s name, Inclusions, Earnest Money, Deadlines, Concessions, and let’s not forget the Inspection Resolution and Personal Property Agreement! Let’s write Contracts for success, instead of setting them….and our Buyers….up for problems and/or failure. We will also discuss some sections that affect the Lender AND the Title Company, so as a team, let’s all work towards reaching the Closing table!
